Amendment of the Regulation on Population and Family Planning

The Decision by the Standing Committee of the Shanghai Municipal People’s Congress on the Amendment of the Regulation on Population and Family Planning of Shanghai Municipality, approved at the 27th plenary session of the Standing Committee of the 14th Shanghai Municipal People’s Congress on 23rd February 2016, has stipulations on family planning policy, child-bearing leave and paternity leave, as below:

1.Article 23 of the newly amended Regulation on Population and Family Planning of Shanghai Municipality stipulates: “It is advocated that a couple only has two children.”

2.Article 31 of the newly amended Regulation on Population and Family Planning of Shanghai Municipality stipulates: “Citizens who get married in compliance with the law are entitled to an extra 7-day wedding leave, in addition to the regular wedding leave, as stipulated by the state. Among couples who give birth in accordance with laws and regulations, women can enjoy 30-day childbearing leave apart from the state-set maternity leave; men can enjoy 10-day paternity leave. Remuneration and benefits on childbearing leave shall be the same as maternity leave. Paternity salary shall be paid equally as salary for normal attendance.”

The Question-Answer Document on the newly revised Regulation on Population and Family Planning of Shanghai Municipality, released by the Shanghai Municipal Health and Family Planning Commission on 26th February 2016,  indicates: “The Resolution by the Standing Committee of the Shanghai Municipal People’s Congress on the Amendment of the Regulation on Population and Family Planning of Shanghai Municipality will take effect as of 1st March 2016. Couples who have registered or will have registered marriage and who have given birth or will have given birth in accordance with laws and regulations during the period from 1st January 2016 to 29th February 2016 can take deferred additional wedding leave, childbearing leave and paternity leave. The additional 7-day wedding leave shall be generally used with the regular wedding leave in a consecutive way (including weekends), and shall be automatically postponed in case of public holidays; The 30-day childbearing leave normally shall be generally used with the regular maternity leave in a consecutive way (including weekends), and shall be automatically postponed in case of public holidays; The 10-day paternity leave shall be used on maternity leave of a delivery woman (including weekends), and shall be automatically postponed in case of public holidays.”
